First: Don’t speak with law enforcement without your lawyer present. You will want to tell your side of the story but doing so will give the government evidence that you may not want them to have. Second: Without a lawyer, you should expect disaster when “going it alone.” Many people believe they are able to navigate this event. Even with years of experience in a courtroom, you are on the other side of the bar. We know you are fearful. Many of us have been right where you are. You need some help.
Our consultants have spent years - even decades - learning their skills. Even if you did have something to do with the event, you can’t “handle this yourself.” You may believe that you are the master of your ship. You may have an advance education. You may be an attorney, nurse, or even a judge. Each profession knows that there are limits to ability. Navigating a federal case is beyond the ability of most folks.
Here is what to expect: The FBI or other Law Enforcement Officers will show up in twos at your office, home, or other place where you frequent. They will play good cop, bad cop. It is a real thing. One will be threatening. The other will play the part of being your friend - or someone who is on your side. This interview will be about one thing: getting you to confess to a crime.
Bad cop will tell you that if you do not tell your side of the event, the Prosecutor will only hear one side of the story and will most likely charge you with a crime. Good cop will tell you that with a confession, he will help you and put in a good word with the Prosecutor. After all, don’t you want the Prosecutor to know that you did not violate the law and if you did, it was not as bad as law enforcement is saying?
You may believe the Prosecutor needs to know that this is your first offense, or you may know the Judge’s son., or some other reason you want to endear yourself with the people who want to take away everything you hold important. You may also want the Prosecutor to know that you attend the local Catholic Church and went to school with the Judge’s cousin. STOP RIGHT HERE. THESE PEOPLE ARE NOT YOUR FRIENDS!
Third: After you spill your guts, you will soon realize that what you just did is let the Prosecutor know that you are the person of interest – the person they are seeking. If law enforcement did not have a suspect, you just ensured they have one now. You may have told the interviewer that you know someone important or some other reason you should be left alone. Let’s think about that a moment:
You may know an important person, but do you believe that person is going public that he knows you and will help you at no cost? Will this person risk ruining his reputation to vouch for you? Will you have any friends? Will your family stand by you? In fact, most important people, friends, and even your family will have nothing to do with you during this event.
By the way, it is unlikely that we would recommend any interview unless you are in the superior position and you are able to exhibit great ability in this endeavor. For sure, you will need one of our lawyers by your side.

Sixth: These days, law enforcement will rarely give you a Miranda Warning. You know, “you have the right to remain silent, anything you say can and will be used against you. You have a right to an attorney. if you cannot afford an attorney, one will be appointed for you.”
You do not get this attorney until you have been arrested and are sitting in jail wondering what just happened to your life. The benefits of Miranda have been so diminished that it is practically useless. By the time police show up, they usually have the case built against you.
